I'm an executive officer of an EU company which runs and/or supports several webcams studios in Russia and CEE region (payments, tech. and req. support, equipment, etc.). Personally I've been dealing with iFriends since 2002 I guess. All we know about iFriends problems and issues like checks (yes, they have implemented online payments but I took them 5(?) years to do that), slow video (even HQ - no need to compare it to LiveJasmin feeds quality for instance), online support who cannot do any thing but suggest you to write an email and many others. I'm talking here about that slow and ugly moster V2 they have proudly created and anounced.
Here is the point: as of Apr 2006 hosts are subject to status. It can be either exclusive - if the host is performing exclusively on iFriends platform - or non-exclusive - if the host appears on iFriends and other webcam platforms simultaneously. This is stated in the VCH Representative agreement I signed. There one may find VCH Rep. and Video Host definitions:
Section "Definitions" of VCH agreement:
| Quote: | 10. "Video Host", "Video Host Client(s)", "I", "my", "you", or "your", shall mean a registered user of our Services who has entered into a Video Hosting Usage and Distribution Services Agreement with our Services.
11. "Video Host Representative" shall mean a third party registered user of our Services who has entered into a Video Host Representative Usage and Distribution Services Agreement with our Services. (Video Hosts are not required to work with a Video Host Representative to Produce Content on or through our Services, but if a Video Host elects to independently contract with a Video Host Representative, that Video Host Representative will receive all Net Usage Payouts generated by a Video Host's ID Card and will be solely responsible for any and all payments to Video Host for the revenue generated by such Video Host's ID Card on or through our Services.) |
These definitions are also given in VCH Rep. Agreement. Next thing is status - there are positions in both agreements saying that (a quotation from Section A of the actual agreement again):
| Quote: | 1.1 Exclusive Platform Usage Fee: If a Video Host provides Content exclusively on or through our Services and does not produce similar content on or through competitive business entities, as determined by us in our sole discretion, the Net Usage Payout for such Content will be equal to fifty percent (50%) of all Net Revenues we collect for that Content.
1.2 Non-Exclusive Platform Usage Fee: If a Video Host provides Content on or through our Services, and also produces similar content on or through competitive business entities, as determined by us in our sole discretion, the Net Usage Payout for such Content will be equal to thirty-five percent (35%) of all Net Revenues we collect for that Content. |
So if there are number of Hosts linked to one representative their status should be determined individually based on the way each Host provides goods and services on iFriends platform. Quite simple, isn't it?
However iFriends thinks different. All our hosts have lost their exclusive status after another accounts review. Not all of them are exclusive but some of them are. So I asked iFriends online support to explain me the reasons and set the status back for our exclusive hosts. Here is the answer (saved from today's live chat):
| Quote: |
VCHHELP [15:04]: <Private> My apologies, if the Representative account is non-exclusive, then any individuals linked under this account will reflect this account status
VCHHELP [15:05]: <Private> Then no hosts linked under your account will be exclusive
|
That's how iFriends understands its own agreements. What is non-exclusive Representative account? How is its exclusive status determined if representative cannot host live sessions? Where in those damned agreements live support sends me to can I find its definition? Why should other truly exclusive hosts be treated like one who has decided to perform on other platforms and agreed to received 35%?
We're cooperating with several industry leaders and none of them went to cheat like that. Yes, this is called cheating. Want those 15%? Fine. Keep it. I'll do my best to convince the rest of our hosts to move to other platforms or unlink them so they could appeal and earn 50% again but don't want to deal with cheaters like iFriends. I wish you to continue going down as you've been doing for the last 3-5 years representing no progress neither in hosts treatment nor in platform development. |
